TERMS OF USE & GENERAL POLICIES
- INCENTIVES
- Annually Paid Hosting & Email Services
Hosted clients will receive a discount of 10% for periodic services paid annually, excluding SSL certificates.
- POLICIES
- Web Site & Server Support
All hosting and support fee differ from client to client and is dependant on the anticipated server resource
usage, degree of support anticipated and the client's particular package. Costs for support of third party applications, or maintenance,
will be charged at the regular development rate unless other wise stated in the client's proposal.
- Bandwidth & Disk Space
Christiansen Consultants does not maintain allotted amounts for bandwidth usage or disk space, but instead maintains a "purpose of use"
policy for the clients' web sites. Meaning, all web site content must be for the purpose of the site. No pornographic material will be allowed,
no print quality photos will be allowed. Additionally, at Christiansen Consultants own discretion, clients may be asked to upgrade their
accounts if their current account activity is insufficient for their expected need.
- Definitions: Maintenance vs. Support
- Support: Is the work needed to ensure that the applications and services are working as intended, that they're functioning as required in regards to the server,
the database and the website applications.
Not all hosting plans include an expressed application support plan. Refer to your written proposal to see if your plan includes support.
For clients with support plans, the support is generally unlimited, unless otherwise stated or when issue resides with third party products and/or services.
Support does not include maintenance.
- Maintenance: Individual, periodic or continuous
work with the intent of changing web site content. Examples included, but
are not limited to new development, new database applications, changing pricing, text changes, editing images, etc.
- Customizations of Shared Applications
Though the client may pay for additions and/or customizations, payment for such to systems and applications owned by Christiansen Consultants, intended for the use by multiple clients, does not gain the requesting
client rights or ownership to these applications and/or systems. Such changes and modifications shall be deemed to be performed as a service.
- FEE STRUCTURE
- Hosted Client Development and Maintenance Fees
- $40 per hour during business hours
- $65 per incident, plus $65 per hour following the first hour during non-regular business hours.
- Non-Hosted Client Development and Maintenance Fees
- $65 per incident, plus $65 per hour following the first hour.
- $85 per hour when required during non-regular business hours.
Regular business hours are 8:00 AM - 5:00 PM Arizona time, Monday through Friday.
- Secure Socket Layer Certificates (SSL)
Charges for basic SSL certificate with installation are $150 per year, $20 additional for the second year.
(based on certificate cost & estimated time to install)
- Web Site backup Copies
Hosted Client Web site backup copies made available for download are priced on a per hour basis.
Payment for producing and handling the backup copy may be required in advance.
- Late Fees
Late Fees are the greater of $40 or 10% of the balance due and may be applied at any time when payment is not received on a timely basis .
- Suspended Site Re-Instatement
Sites with past due invoices are subject to suspension and/or deletion. Suspended sites will be charged for storage an amount equal to their regular
hosting and any support. The Fee for suspending sites is $40. Sites having been suspended must full pay all invoices due plus the suspension fee to be made active.

- Payment for periodic services must be received by the first day of a period.
- Payment for development and/or maintenance services for less than $500 must be received within 15 days of issuance
- Payment for development and/or maintenance services for $500 or more must be received within 7 days of issuance
Christiansen Consultants reserves the right to refrain from providing any services for delinquent accounts.
- REFUNDS
- Refunds
- Without prior notification, Christiansen Consultants reserves the right to suspend or terminate accounts, remove or modify any files which are deemed to be a threat to the functionality or existence of Christiansen Consultants' System.
- Cancellations will NOT automatically generate ANY refund.
- No refunds will be paid for services already performed.
- All deposits are non-refundable.
- DISPUTE RESOLUTION & INDEMNIFICATION
- Jurisdiction
Your use of this Site and Purchases of the Services of Christiansen Consultants shall be governed in all respects by and construed in accordance with the laws of the State of Arizona, U.S.A.
You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this Site (including but not limited to the purchase of Christiansen Consultants services) shall be in the state or federal courts
located in Maricopa County, Arizona. Any cause of action or claim you may have with respect to the Site (including but not limited to the purchase of Christiansen Consultants services) must be commenced within one (1) year after the claim
or cause of action arises. Christiansen Consultants' failure to insist upon or enforce strict performance of any provision of these Terms and Conditions of Use shall not be construed as a waiver of any provision or right. Neither the course of
conduct between the parties nor trade practice shall act to modify any of these terms and conditions. Christiansen Consultants may assign its rights and duties under this Agreement to any party at any time without notice to you.
If, for any reason, a court of competent jurisdiction finds any provision of these Terms and Conditions of Use, or any portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to effect the
intent of this agreement, and the remainder of these Terms and Conditions of Use shall continue in full force and effect.
- Indemnification
You agree to release, indemnify, and hold us, our contractors, agents, employees, officers, directors and affiliates harmless from all liabilities, claims and expenses, including lawyers fees, relating to or arising under
the Terms and Conditions, the Services or your use of the Services, including without limitation infringement by you, or someone else using the Services with your computer, of any intellectual property or other proprietary
right of any person or entity, or from the violation of any of our operating rules or policy relating to the Services. You also agree to release, indemnify and hold us harmless pursuant to the terms and conditions contained in
the Dispute Policy. When we are threatened with suit by a third party, we may seek written assurances from you concerning your promise to indemnify us; your failure to provide those assurances may be considered by us
to be a breach of the Terms and Conditions and may result in deactivation of your services.
- ACCEPTANCE OF POLICIES
- Confirmation Of Acceptance
The Commissioning for, or payment against, any product or service provided for by Christiansen Consultants will be construed as acceptance for the aforementioned where applicable.
- Precedence
These Terms and Conditions supersede all previous representations understandings or agreements and shall prevail notwithstanding and variance with terms and conditions of any order submitted.
